Contract language

The languages available for concluding the contract are English and German.

Where these Terms & Conditions are made available in both English and German, both versions are intended to reflect the same terms. In the event of any discrepancy between the language versions, the German version shall prevail, to the extent permitted by applicable law.

1. Scope

These Terms & Conditions apply to all orders placed by consumers through the online shop of Guimi UG (haftungsbeschränkt) at byguimi.com.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

2. Contracting party

3. Conclusion of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

Customers can select products and add them to their shopping cart. Before submitting the order, the order details can be reviewed and amended.

By clicking the button to place an order with an obligation to pay, the customer submits a binding offer to purchase the goods contained in the shopping cart.

After the order has been received, the customer will receive an automatic order confirmation by email. The purchase contract is concluded when Guimi expressly accepts the order or dispatches the goods.

The languages available for concluding the contract are German and English.

4. Prices and payment

All prices displayed in the online shop are final prices in euros and include statutory VAT.

Any additional shipping costs will be displayed to the customer before the order is completed.

The payment methods currently available are displayed during the checkout process.

5. Delivery

We deliver to the countries within the European Union listed on our website.

Unless otherwise stated for the respective product, orders are generally dispatched within 1–2 working days after receipt of the order.

The estimated delivery time after dispatch is generally: Germany 1–2 working days; other EU countries 2–5 working days.

These are typical delivery times. Delays by the shipping carrier may occur in individual cases.

If an ordered product is exceptionally unavailable, we will inform the customer without undue delay and refund any payments already made.

6. Retention of title

The goods remain the property of Guimi UG (haftungsbeschränkt) until payment has been made in full.

7. Right of withdrawal

Consumers have the statutory right of withdrawal.

Information about the right of withdrawal, the withdrawal period and the consequences of withdrawal can be found in our separate Right of Withdrawal notice.

8. Return shipping costs in the event of withdrawal

The customer bears the direct costs of returning the goods in the event of withdrawal.

Guimi offers a prepaid return label for returns. If this label is used, the cost of the return label will be deducted from the amount to be refunded: Germany €4.90; other EU countries €9.90.

Alternatively, the customer may arrange and pay for the return using a shipping carrier of their choice.

These return shipping costs do not apply to justified claims concerning defective or incorrectly delivered goods. The customer's statutory warranty rights remain unaffected.

9. Warranty

Statutory warranty rights apply.

If delivered goods are defective, the customer is entitled to the statutory remedies, including subsequent performance and, where the statutory requirements are met, further rights such as a price reduction, withdrawal from the contract or damages.

In the event of a justified claim, Guimi will bear the costs necessary for subsequent performance, including the necessary transport costs.

10. Liability

Guimi's liability is unlimited for damages resulting from injury to life, body or health, as well as for damages caused intentionally or through gross negligence.

In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damages typical for this type of contract.

The statutory provisions on product liability remain unaffected.

11. Dispute resolution

Guimi UG (haftungsbeschränkt) is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final provisions

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
